1. Scope
1.1 These General Terms and Conditions apply to all orders, enquiries and contracts of sale relating to goods offered by KUR AG via the secure members’ area, the online shop or by other electronic means.
1.2 The offer is directed at both consumers and business customers.
A consumer is any natural person who enters into a legal transaction for purposes which are predominantly neither commercial nor related to their self-employed professional activity.
A business is a natural or legal person, or a partnership with legal capacity, which, when entering into a legal transaction, is acting in the course of its commercial or self-employed professional activity.

1.4 Any terms and conditions of the customer that differ from these shall only form part of the contract if KUR AG expressly agrees to their validity.
2. Access to the Members’ Shop
2.1 The secure Members’ Shop is accessible to members who have registered and been authorised by KUR AG.
2.2 Authorisation of member access entitles the member to use the secure area. It does not constitute a right to enter into a contract of sale.
2.3 KUR AG is entitled to verify registrations and member access and to refuse or block access for objective reasons.
2.4 Personal login details must be treated as confidential and must not be disclosed to third parties.
2.5 A member may only use the Members’ Shop for their own purposes or for the purposes of the registered company.
3. Product range
3.1 KUR AG’s product range may include, in particular, the following product groups:
-
electronic devices and accessories,
-
cosmetics and personal care products,
-
dietary supplements,
-
furnishings and fittings,
-
other products listed in the relevant range.
3.2 The key characteristics of a product are set out in the relevant product description, the technical specifications and, where applicable, the manufacturer’s information.
3.3 Product images are for illustrative purposes only. Unless expressly guaranteed, minor variations may occur, particularly with regard to colour, appearance, packaging or design.
3.4 KUR AG reserves the right to remove products from its range at any time, to amend product descriptions and to expand its product range.
4. Product information
4.1 KUR AG endeavours to provide complete and clear product information.
4.2 Technical specifications, manufacturer’s specifications and other product information are subject to change where necessary due to further developments or changes made by the manufacturer.
4.3 For electronic devices, the relevant operating, safety and manufacturer’s instructions also apply.
4.4 The customer undertakes to use devices exclusively in accordance with their intended use and the relevant safety and operating instructions.
5. Prices
5.1 The prices stated in the members-only shop are valid at the time of the order or enquiry.
5.2 Where required by law, prices are quoted inclusive of the applicable value-added tax.
5.3 Any additional costs incurred, in particular postage, delivery, assembly or installation costs, shall be disclosed before the contract is concluded or agreed upon individually.
5.4 In the case of equipment, the final price may differ from the price displayed in the shop due to the specific scope of delivery, additional services or special requirements. In such cases, the binding price is determined by the individual quotation or the order confirmation.
6. Order Process and Conclusion of Contract
6.1 The display of products in the online shop does not, as a general rule, constitute a binding offer by KUR AG to conclude a contract of sale, unless otherwise expressly stated in the relevant offer.
6.2 Depending on the product group, the order may be placed directly via the online shop or initially accepted as an enquiry.
6.3 For products where a personalised ordering process is required, the online enquiry initially constitutes a non-binding enquiry from the customer.
6.4 Upon receipt of an enquiry, KUR AG may contact the customer to discuss the product, scope of delivery, availability, delivery, installation, training or other details.
6.5 In the case of equipment, KUR AG may subsequently send the customer a bespoke quotation or an order confirmation.
6.6 In the case of an individual quotation process, a contract is only concluded upon the customer’s express acceptance of the quotation or the order confirmation, unless otherwise stipulated in the relevant document.
6.7 For products that can be ordered directly via the online shop, the contract is concluded in accordance with the ordering process set out there.
6.8 KUR AG is under no obligation to accept every enquiry or order. An order may be rejected, in particular, in the event of unavailability, technical or organisational obstacles, or other objective reasons.
7. Special provisions for electronic devices
7.1 Due to the nature of the electronic devices on offer and the fact that some may require further explanation, KUR AG may provide for a personalised ordering process.
7.2 In this case, the following applies:
Enquiry → face-to-face consultation → bespoke quotation / order confirmation → acceptance → delivery
7.3 During the face-to-face consultation, technical questions, the scope of delivery, installation conditions, accessories, installation, training and other requirements can be clarified.
7.4 The binding terms of the contract are set out in the individual quotation or the order confirmation.
7.5 Statutory consumer rights remain unaffected by this.
8. Delivery
8.1 Delivery shall be made to the delivery address specified by the customer and confirmed by KUR AG.
8.2 The estimated delivery time shall be stated in the relevant quotation, at the time of ordering or in the order confirmation.
8.3 In the case of individually agreed delivery, assembly or installation services, the relevant details set out in the individual quotation shall apply.
8.4 Should an agreed delivery not be possible on time due to force majeure, supply bottlenecks, delays on the part of upstream suppliers for which KUR AG is not responsible, or other unforeseeable events, KUR AG shall inform the customer accordingly.
8.5 The customer’s statutory rights in the event of delivery delays remain unaffected.
9. Payment
9.1 The available payment methods are specified during the relevant ordering process or in the individual quotation.
9.2 In the case of high-value equipment, KUR AG may agree on a deposit or full payment prior to delivery.
9.3 The relevant payment deadline is set out in the ordering process, quotation or order confirmation.
9.4 In the event of late payment, the statutory provisions shall apply.
10. Retention of title
The goods delivered shall remain the property of KUR AG until the purchase price has been paid in full, insofar as a retention of title can be validly agreed under applicable law.
11. Warranty – Consumers
11.1 Statutory warranty rights apply to contracts with consumers.
11.2 In particular, the statutory provisions of the Liechtenstein Consumer Warranty Act apply to purchases of goods by consumers.
11.3 In the case of goods containing digital elements, the statutory requirements regarding provision and any necessary updates shall apply.
11.4 These General Terms and Conditions do not exclude or restrict the consumer’s statutory rights.
11.5 Where an additional manufacturer’s warranty exists, it shall be granted in accordance with the relevant warranty terms and conditions. A warranty shall only exist if it has been expressly designated as such.
12. Warranty – Traders
12.1 For customers acting as traders, the statutory provisions of the applicable law shall apply, taking into account the specific provisions applicable to traders.
12.2 To the extent permitted by law, different provisions may be agreed for traders with regard to inspection, notification of defects, the warranty period and subsequent performance.
12.3 Any such individual agreement shall take precedence over the general provisions of these General Terms and Conditions.
12.4 Statutory claims that cannot be waived remain unaffected.
13. Rights of withdrawal and cancellation for consumers
13.1 In the case of distance contracts with consumers, the statutory rights of withdrawal and cancellation as provided for by law shall apply.
13.2 The details shall be communicated to the consumer in a separate notice of withdrawal.
13.3 KUR AG does not exclude statutory consumer rights through these General Terms and Conditions.
13.4 Where a statutory exception to the right of withdrawal or cancellation applies to individual goods or types of contract, the consumer shall be informed of this accordingly before the contract is concluded.
13.5 There is no statutory consumer right of withdrawal for business customers.
14. Cosmetic products
14.1 Cosmetic products must be used in accordance with their intended purpose and the relevant instructions for use.
14.2 The customer must observe the instructions for use and warnings stated on the product, the packaging or in the product description.
14.3 Individual intolerances or allergic reactions cannot be ruled out in general. In the event of known allergies or intolerances, the listed ingredients must be checked before use.
14.4 Statutory requirements regarding the labelling, composition and safety of cosmetic products remain unaffected.
15. Dietary supplements
15.1 Dietary supplements must be used in accordance with the recommended intake.
15.2 The recommended daily intake must not be exceeded, unless there is a statutory or scientifically justified recommendation to the contrary.
15.3 Dietary supplements are not a substitute for a balanced and varied diet and a healthy lifestyle.
15.4 The product information is provided for information purposes only and does not constitute individual medical advice.
15.5 In the event of pregnancy, breastfeeding, illness, the use of medication or other specific health conditions, a suitably qualified healthcare professional should be consulted before taking the product.
15.6 Food supplements are subject to the applicable food law regulations. In particular, no unauthorised disease-related or unapproved health-related effects are claimed.
16. Furnishings
16.1 The relevant product descriptions and agreed specifications shall apply to furnishings.
16.2 In the case of individually configured or bespoke furnishings, the specific design features shall be set out in the quotation or the order confirmation.
16.3 Where required by law, consumers shall be informed, prior to the conclusion of the contract, of any existing exceptions to the right of withdrawal in respect of bespoke goods.
17. Health-related information and no promise of a cure
17.1 Information on the website, in the members’ area and in product descriptions is provided solely for general information purposes.
17.2 It is not a substitute for a medical examination, diagnosis or treatment, nor does it constitute individual medical advice.
17.3 KUR AG does not guarantee any specific health-related outcome.
17.4 In particular, no assurance is given that a product will diagnose, treat, cure or prevent any illness, unless such a statement is expressly permitted by law and clearly indicated as such.
17.5 The individual effects and experience of products or treatments may vary from person to person.
17.6 In the event of health complaints or existing medical conditions, a qualified healthcare professional should be consulted before using any suitable products or devices.
18. Liability
18.1 KUR AG shall be liable in accordance with the statutory provisions.
18.2 Limitations of liability shall not apply to damage resulting from loss of life, personal injury or damage to health, nor to any other cases in which a limitation of liability is prohibited by law.
18.3 In all other respects, KUR AG shall only be liable to the extent permitted by law.
18.4 Liability for damage resulting from the improper or unauthorised use of products is excluded, provided that the legal conditions for liability are not met.
19. Data Protection
19.1 The processing of personal data is carried out in accordance with the applicable data protection regulations.
19.2 Further details are set out in KUR AG’s separate privacy policy.
19.3 The privacy policy forms part of the information provided on the website, but does not form part of the relevant contract of sale, unless otherwise provided for by law.
20. Copyright and Intellectual Property
20.1 Texts, images, graphics, videos, product illustrations, logos and other content on the website are protected by copyright, unless otherwise indicated.
20.2 Any reproduction, publication, adaptation or other use beyond the statutory limitations of copyright law requires the prior consent of the relevant rights holder.

23. Governing Law
23.1 Contracts shall generally be governed by the law of the Principality of Liechtenstein, to the exclusion of conflict-of-law rules, provided that this is not precluded by mandatory statutory provisions.
23.2 In relation to consumers, mandatory consumer protection provisions of the State remain unaffected, the application of which is a statutory right of the consumer.
23.3 For business customers, the agreed Liechtenstein law applies, provided that no mandatory statutory provisions preclude this.
24. Jurisdiction
24.1 In relation to consumers, the statutory provisions on jurisdiction shall apply.
24.2 In relation to businesses, Vaduz, Principality of Liechtenstein, shall be the place of jurisdiction, to the extent permitted by law.
